レッサーパンダが立てば、商標ビジネスで儲かる？？
風太が一大旋風を巻き起こしている。あの立ち上がったレッサー
パンダである。その『風太』という名前を商標登録し、さらに、
そこにキャラクタービジネスとかを絡めて動き出そうとしている
人たちが多く群がっているのである。さて、この商標とか特許、
ビジネスでは、どう考えるべきなのだろうか？？
ようやく日本でも、知的財産権に関する最高裁ができた。もっとも、
その最初の裁判が、松下 vs ジャストシステムというのが、なんとなく
象徴的な気もするのだが....
一次期は、ビジネスモデル特許など大騒ぎになっていたこともあり、
とにかく、ビジネスの新規立ち上げとか、ベンチャー企業では、
『ビジネスモデル』という言葉がよく使われる。
また、商標も大きな利権ビジネスとして動いており、『ホリエモン』
という商標についても話題になっている。インターネットで言えば、
ドメインも大きな利権であり、使えそうな名前、商品になりそうな
名前を先にとってしまうというビジネスも出てきている。
しかし、そんなことばかりでいいのか？という気もする。先の
『風太』に限らず、『たまちゃん』、『ホリエモン』といった商標を
取って、最初からそれを売ることだけで仕事にしょうとしているが、
それって、どうなのだろうか？？
問題になるのは、このようなことを続けていると、結局は、自由
競争が難しくなり、何かビジネスを起こすごとに、いろんなところへ
ロイヤリティー（ようは使用料）を支払わなければならず、最初から
参入障壁が高いものになってしまうのではないだろうか？ 特に、
ビジネスの基本となるような基幹業務や、インフラに関する部分で
特許や商標で押さえ込まれると、非常にビジネスをしにくいものに
する可能性が高い。
しかし、その一方で、もともとの知的財産の考えからいくと、
当たり前すぎる話だが、『がんばって発明した人には、それなりの
見返りがあって当然でしょう』ということも理解できる。世の中に
本当に役立つものを発明した人に、何の利益もないなら、そういう
努力をする人たちが出てこなくなる。あの青色発光ダイオードの
特許の騒ぎにしても、要するにそういう開発を地道にやってきた
人たちの努力を認めてあげるべきではないか？という主張であり、
その一方で、会社側は、環境を用意し、自由に研究させてやったでは
ないか？という意見の食い違いだった。
ただ、今後のビジネスを考えていくと、『儲けるための知財』と
いうよりも、『守りのための知財』と考えておいた方がいいのかも
しれない。特に中小企業ががんばって作り出したものを大手に足元を
すくわれるといったことにもなりかねないからだ。特許を持っていれば、
大手のとの交渉にも有利になるし、自分たちのビジネスを進める上で、
安心して展開できるということもある。
また、本当に面白いアイデアや使い方が閃いた場合は、それをより
多くの人たちに広めるには、やはり特許を持っていた方がやりやすい
こともある。そういう意味では、単にレッサーパンダが立ち上がった
から、商標登録するというようなことではなく、自分のアイデアを
活かすべく、特許や商標を利用してほしい。
実際に特許申請や商標登録の手続きが分からなければ、どうにも
ならないので、ちょっと面白いサイトを見つけたので紹介しておく。
